The Governors Office of Highway Safety reports that Florida has determined that Sobriety Checkpoints are legal under the federal constitution. Who are they kidding? The United States Constitution fourth Amendment protects citizens from unreasonable search and seizure. Sobriety Checkpoints allow officers to stop cars that have otherwise not committed any traffic offense. In fact, Florida DUI lawyer s contend that they allow officers to stop innocent law abiding citizens who are not doing anything wrong for the purpose of smelling them. That is just nasty. Is it an intrusion into their private space? If anyone else came up and asked a person to roll down their window and then sniffed them, they would call the police.

Many states agree that these checkpoints are intrusions under the constitution. Alaska, Montana, Michigan, Texas, Oregon, Rhode Island, Washington, and Wyoming all prevent the use of Sobriety Checkpoints as a violation of either state law, state constitution, or interpretation of the US Constitution.
